Terms and Conditions for members

These terms and conditions refer to the conditions of membership of the Marketing Quotes service.

For the conditions of general use of the website, we suggest you read the Ownership, Clarification of Terms and Copyright sections of this document and the privacy policy.

Clarification of terms

• arketing Quotes, We, Our and Us all refer to Positive Move Limited.
• The website refers to the entire website under the domain marketingquotes.co.uk
• Quotes website refers to any website at a domain similar to designquotes.co.uk where the website states that it is part of the Marketing Quotes group of websites, or that it is owned by Positive Move Limited.
• Member means a company or individual that has signed up to our service to receive enquiries for their products or services.
• Visitor means a visitor to a quotes website (such as designquotes.co.uk) who is interested in receiving quotes for the product offered by that website. E.g. graphic design.
• Client means a visitor who entered their details on the quotes website in order that a member might respond to their enquiry.

Copyright

All copyright and other intellectual property rights in all the material on the site including but not limited to website design, page layouts, graphical images and website text legally belong to Marketing Quotes and our relevant members. The members own the rights to their own profiles, logos, and other supplied content.

Privacy Policy

Please read our separate privacy policy for information on how we use any personal or company details you may supply us with.

The Service

By using the services offered by this website and Marketing Quotes you are agreeing to comply with these terms of use without limitation. In addition, you agree not to post any material unless you own the copyright.

Marketing Quotes does not and can not always review company details or testimonials that are posted on this website, nor can we confirm the validity of information supplied by our members or clients, for which we are not responsible.

While Marketing Quotes tries to confirm the requirements of our visitors, we provide no guarantee of the lead's authenticity, nor that The Client will complete any deals or be ready to accept the services offered by our members.

Members remain responsible for the content of their company details. You agree to exclude Marketing Quotes from any claims relating to the use of information on this website.

Use of client's data

When you open a lead you have access to all the data we have about that client. This data must used strictly the purpose of dealing with the enquiry, and must not be kept on file for future mailings or passed to any external company without the client's express consent.

For example, if a client uses the design quotes service to submit an enquiry requiring photography that we send out to graphic design agencies, they must secure the clients permission before passing any clients data over to a third party photographer.

Payment terms for the affiliate program

We will pay the agreed fee whenever a Visitor (who we can trace as originating from your website) places an enquiry on one of our quote sites, which eventually sells to at least one registered member.

You will be paid via the arranged method once a month, following receipt of funds from the purchasing members.

Payment terms for selling leads

Leads sold to Marketing Quotes must meet certain conditions: The Client must be aware their details are being passed to an external company; you must not be bidding, or have already won the work; they must have expressed a genuine interest in the service the lead mentions.

You will be paid the agreed fee if we receive funds from at least one member for this lead. That amount will be doubled if the maximum numbers of members pay for the lead.

You will be paid via the arranged method once a month, following receipt of funds from the purchasing members.

Payment terms for buying leads

Paying-up-front

Credits are refundable only at the discretion of our staff or agents, and may not be sold or transferred to any other member or third party. Any disputes with leads purchased on credit can only result in a refund of the credits used to purchase that lead.

Paying monthly

The billing month runs up until 10 days before the 1st of each calendar month. On this date you will be invited to log into your account to read an invoice of all the leads you have opened in that period. You then have 10 days to raise any disputes before payment is required on the 1st of the following month.

Ordinarily, payment will be taken by Marketing Quotes using the card details you have previously saved. Should this fail for any reason, you are required to pay the invoice within the following week.

Invoices that remain outstanding beyond the 10th of each month will be passed to a collection agency and will incur interest subject to the late payments legislation.

Refunds and credits

All refund requests must be made within 10 days of opening a lead, and must be made in accordance with the refund policy.

Promotion of Marketing Quotes

By using our service as a client or member you are agreeing to allow Marketing Quotes to use your company name and or logo on the website for the purpose of displaying who has used our services, unless we have received express notification to the contrary.

Violation of these conditions

Marketing Quotes reserves the right to delete any enquiry, response or company profile, at any time, for any reason. Persistent abuse of the terms of use or breach of these guidelines may result in action being taken against the relevant party. These terms of use are in addition to any legal rights that Marketing Quote retains.
